Horizon Winds up Maxpeak Ltd in the High court
Horizon Global Electronics Ltd won its petition No 582 of 2010 in the High Court of Justice Chancery Division Company’s court on the 10th of March 2010 to have Maxpeak Ltd wound up under the provisions of Insolvency Act 1986.
One of the official receivers attached to the court is by virtue of the order appointed liquidator of the company and it is ordered that the costs of the petitioner (Horizon) be paid out of the assets of the company (Maxpeak Ltd).
This winding up order was a consequence of Horizon’s success in the High Court against Mr Patrik Lagerstedt and Maxpeak Ltd. Mr Lagerstedt was made personally bankrupt on the 12th January 2010 stating his profession as unemployed. Mr Lagerstedt has resigned from his seat on the board of Maxpeak AB and as a director of Maxpeak Ltd (which owns Maxpeak India
Pvt Ltd).
Since 2007 Horizon Global Electronics has been involved in a legal action with High Court in London against Mr. Patrik Lagerstedt and his company Maxpeak Ltd.
The defence case adopted by Mr Lagerstedt and Maxpeak Ltd since the beginning of the proceedings collapsed dramatically only days before the trial. In a document subsequently submitted to the Court, Mr Lagerstedt admitted that he lied in his written evidence. As a result of that, Mr Lagerstedt and Maxpeak Ltd admitted liability. The essence of the claim against Mr Lagerstedt and Maxpeak was that Mr Lagerstedt had diverted a maturing business opportunity away from Horizon to Maxpeak, while he was a director and employee of Horizon. Horizon always maintained that Mr Lagerstedt had diverted away from it the opportunity to exploit a new form of technology for use in satellite meters.
According to the evidence, Mr Lagerstedt formed his own company Maxpeak Ltd while still in employment with Horizon and started using the technology along with the Sharp IC for his own use in a satellite meter called SAM.
